Our Appeal has been Filed
The next round in our long battle to stop oil wells in Balcombe has commenced. We are grateful for the continued support of our lawyers, Leigh Day and barristers, David Wolfe KC and Merrow Golden.
On October 31st, we filed an application for permission to appeal at the Court of Appeal. This will be decided by a judge reviewing our grounds for appeal. We expect to hear their decision in 3 to 4 months’ time. If we are successful in being granted an appeal, then our appeal will be held in court before three judges and may take 6 to 9 months.
New evidence is not allowed in this type of appeal. Rather, the appeal is an evaluation of the legal conclusions of the judge. If the appeal is successful, the Court of Appeal, composed of a three- judge panel, will make a new judgement, which supersedes the High Court judgment.
While the appeal is in process Angus Energy will not be returning to the well site.
